The Member of Parliament for Old Tafo, Vincent Ekow Assafuah, has revealed his plans of seeking a review of the Supreme Court's ruling on the case involving the removal of Chief Justice Gertrude Torkornoo.
This follows the Court's decision to dismiss his application to stop the process for her removal and to revoke her suspension.
On May 6, 2024, the Supreme Court ruled by a narrow 3-2 majority to reject Assafuah’s request. Acting Chief Justice Paul Baffoe-Bonnie, along with Justices Yonny Kulendi and Amadu Tanko, were in favor of dismissing the injunction request, while Justices Henrietta Mensah Bonsu and Ernest Gaewu dissented. The Court revealed that the full reasoning for its decision would be made available on May 21, 2025.
In an interview with Channel One Newsroom, Assafuah acknowledged the Court's decision to delay releasing its detailed reasoning. He stated that he would wait for the full explanation before deciding his next steps, but made it clear that if the reasoning did not convince him, he might pursue a review of the decision.
"The Supreme Court says that on the 21st of May, the reasoning behind their ruling will be made available to us," Assafuah explained. "When it is finally made available, then I will see the reasoning behind it—whether or not it holds water. If it does, I leave the matter to rest. If it doesn’t, in my opinion, then I am likely to file for a review."
The Member of Parliament also pointed out that his legal position had found partial support within the Supreme Court. He noted that two of the justices had agreed with his argument, indicating that he might have grounds to return to the Court. "Even before getting hold of the reasoning, it is clear that even at the Supreme Court, two of the judges agreed with my position and ruled in favour of my arguments," he said. "So, it gives me some indication that I am likely to go back to the Supreme Court."
